SMS Policy & 10DLC Compliance

Purpose

This document outlines how Preferred Homes Corp / Preferred Homes Corp obtains client consent to receive SMS notifications about their real estate transactions and mortgage applications, in full compliance with 10DLC, TCPA, and CTIA guidelines.

Types of Messages You May Receive

When you opt in to receive SMS messages from us, you may receive:

  • Application status updates - Progress on your mortgage application
  • Document requests - Notifications when we need additional documentation
  • Rate-lock confirmations - Confirmation of your interest rate lock
  • Closing date reminders - Important dates and deadlines
  • Property listings - New properties matching your criteria
  • Market insights - Updates on market conditions and rates
  • Exclusive opportunities - Marketing messages and promotional offers

How We Obtain Your Consent

We obtain your express written or verbal consent to send SMS messages through one or more of the following methods:

Method 1: Digital Consent (Web Form)

Step 1: Form Access

You navigate to our website at preferredhomescorp.com and fill out a form (consultation request, mortgage application, or contact form).

Step 2: SMS Opt-In Checkbox

The form displays an optional, unchecked by default checkbox with the following disclosure:

I agree to receive SMS notifications and marketing texts from Preferred Homes Corp (optional).

"By providing your phone number, you are opting into marketing texts and agree to receive SMS notifications from Preferred Homes Corp. Message frequency may vary. Standard message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Consent is not a condition of purchase. We will not share your mobile information with third parties for promotional or marketing purposes. View our Privacy Policy at preferredhomescorp.com/privacy."

Step 3: Checkbox Properties

  • ✓ Optional - NOT required to submit the form
  • ✓ Unchecked by default - user must actively check it
  • ✓ Specific and explicit - separate from other consents
  • ✓ Not buried - clearly visible, not hidden in terms
  • ✓ Marketing disclosure - explicitly states "marketing texts"

Step 4: Confirmation SMS

If you check the box and submit with verified phone, you receive:

"Preferred Homes Corp: Thank you for opting in to receive SMS updates from Preferred Homes Corp! Msg frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help. We will not share your mobile information for marketing purposes."

Method 2: Verbal Consent for Marketing Use Case (Phone or In-Person)

This method uses a double opt-in process as required by carriers for marketing messages.

Our representative presents the consent process verbally:

By providing your phone number to Preferred Homes Corp, you are consenting to receive informational updates and marketing messages via text from us. Message and data rates may apply. Message frequency may vary. You can text HELP for support or more information and STOP to unsubscribe at any time. We will not share your mobile information with third parties for marketing. Customer Verbal Agreement

Once you agree verbally, your phone number is recorded.

Step 1: Initial Confirmation SMS

You receive an initial confirmation message:

"Preferred Homes Corp: You have agreed to receive SMS updates. Msg frequency varies. Msg&data rates may apply. Reply STOP to unsubscribe, HELP for help. To confirm you also want to receive marketing messages please reply YES"

Step 2: User Replies YES (Optional)

If you reply YES, you receive final confirmation:

"Preferred Homes Corp: Thanks, you have now been subscribed to SMS notifications, including promotions from Preferred Homes Corp. Msg frequency varies. Msg&data rates may apply. Reply STOP to unsubscribe or HELP for help."

Important: If you do NOT reply YES to the marketing confirmation, you will only receive informational messages (application updates, document requests, etc.) and will NOT receive promotional or marketing messages. This double opt-in is required by carriers for marketing use cases.

Method 3: Opt-In by Keyword

We provide a keyword (e.g., "START") and phone number via website, flyer, QR code, business card, or email signature.

Automated Response

When you text the keyword to (786) 227-2868, you receive:

Message Frequency and Rates

Message frequency varies based on your transaction activity, market updates, and promotional campaigns. You may receive approximately 2-8 messages per month.

Message and data rates may apply depending on your mobile carrier plan. Standard text messaging rates apply as per your carrier's plan.

How to Opt Out

You can opt out of SMS messages at any time. We respect your choice and make it easy to unsubscribe.

Opt-Out Keywords

Reply to any of our messages with one of the following keywords to opt out immediately:

STOP
STOPALL
UNSUBSCRIBE
CANCEL
END
QUIT

Opt-out requests are processed immediately. You will receive a confirmation message that you have been unsubscribed from future messages.
